FM and PM are legal on any frequency that phone operation is allowed except for the 60 meter band.  The only restriction is that the modulation index cannot exceed 1 on frequencies below 29.0 MHz.

Why not run NBFM on 40 and 20 ?? Its legal and I bet you would get more attention that way. Maybe too much ??
