[c-nsp] 7600 ES line card traffic policing outbound

Hi,
The standard policy-map with police command cannot be applied to sub-interface for outbound direction:
policy-map TEST class class-default  police 3000000000
int ten3/0/0.240service-policy output TEST  
Police and strict priority must be configured together for egress QOS.Invalid feature combination for the class class-defaultConfiguration failed on TenGigabitEthernet3/0/0.240
If we add 
policy-map TEST class class-default  police 3000000000 priority
Then it works, however it polices traffic way below the value provided, if said police is 3g, the Customer traffic gets policed below 2g and then sequential with same pattern packet drops start occurring.
Hardware: 7600 router with 7600-ES20 line card.
However shaping outbound works, but I would prefer policing.
Any ideas, what could be wrong here?
