The unity licensing docs state that the server has to
have a license file that matches the servers MAC
address (primary, virtual, etc). 

I couldn't find a doc that states it continues to work
with a license that doesn't match. But I guess it may
depend on how you're restoring and how the license
gets there maybe. Maybe if you're restoring from
backup, the files are already there and license is not
being added new. Maybe they let unity run as long as
there is a license for a bit in case of disasters
where someone had to restore to another server so they
weren't totally out while the new license was coming.
You could try posting something on the cisco unified
messaging forum , there are a few cisco unity folks
that reply out there frequently.

License Files and MAC Addresses

Each license file (except the default license file) is
registered to the MAC address (physical address) of
the network interface card (NIC) on the Cisco Unity
server. The license file for one computer cannot be
used on a second computer (for example, because you
want to replace the Cisco Unity server). You must
obtain a replacement license file registered to the
MAC address on the second computer. See the "Replacing
License Files When Replacing a Cisco Unity Server"
section.
