   Dear Sirs
   It has been brought to my attention that an unknown person(s) has
   recently created a domain / mail address with yourselves using the
   above details with the intention of misleading consumers into believing
   the therein-reference company is TNT Express or TNT Mail, both
   wholly-owned subsidiaries of TNT NV, a Netherlands based company
   (collectively âTNTâ hereinafter). Furthermore as the site is used for
   unlawful purposes including criminal deception it is unlikely that the
   registrant details that you hold are legitimate and correct, which
   constitutes a direct breach of the ICANN Registrar Accreditation
   Agreement clause 3.7.7.2.
   To date, we know of many individuals who have been misled through the
   use of this erroneous mail address, and many have either completed the
   purchase of goods through eBay and other internet auction sites (i.e.
   having paid money via wire transfer or otherwise for intended
   purchases) for which goods would be shipped to them by the alleged
   seller via the above mail address, or indeed, have been advised (as
   part of an advanced fee fraud) that they have been the winner of
   lottery proceeds (which are false).
   When the buyers inquired into the shipment status or the fictitious
   goods or winning payments, they have been informed that the shipment
   had been cancelled, or have received no further feedback from those
   suspected of committing crimes of deception, fraud and additional
   offences. Thereupon, buyers have called TNT locations globally to
   inquire as to the reasons for such cancellation. We have then had the
   difficult task of informing them that the goods they thought they
   purchased were not shipped by either of the TNT companies or any other
   TNT-affiliated company.
   Having conducted a careful comparison between the information presented
   through such e-mails originating from / directed to the address above
   and our own websites, specifically the generic site of [1]www.tnt.com
   or derivatives of our legitimate site (country specific) and belonging
   to our organisation globally, we can clearly conclude that the vast
   majority of the text in the above address mail contents or domain
   (hereinafter âInfringerâ) comes directly from our corporate websites.
   For example:
   1)        The infringer makes repeated use of âTNTâ (not to mention
   additional references to our organisation and corporate entity)
   throughout its website and / or email correspondence.
   2)        The infringer is using as its own an actual TNT logo which,
   until three or four years ago, has been used by approximately 30 TNT
   companies for many         years.
   3)        Unless otherwise provided below and with the exception of
   photographic images (unless otherwise noted), the infringer has
   duplicated and is using the exact text from TNTâs two websites on each
   of the following web pages:
   o        âAbout Us â Rewardsâ
   o        âAbout Us â Environmentâ
   o        âAbout Us â Historyâ
   o        âAbout Us â ISO certificationâ
   o        âAbout Us â Operational excellenceâ
   o        âAbout Us â Overviewâ (with the exception of certain figures)
   o        âAbout Us â Our mission and visionâ
   o        âShipping Information â Packaging guidelinesâ (including
   photographic images)
   o        âShipping Information â Customs requirements and tipsâ
   o        âShipping Information â Consignment Noteâ (including image of
   TNTâs note but with Infringerâs logo)
   o        âTechnology Tools â Track A Shipmentâ (except for different
   consignment number system and sample numbers)
   o        âAgreements â Disclaimerâ
   o        âAgreements â Privacy statementâ (with some modifications)
   4)        Within the e-mail correspondence, the infringer uses portions
   of TNT text from each of the two websites.
   5)        The vast majority of the descriptive headers on the
   infringerâs mails are also those of TNT.
   6)        The infringer is providing direct hyperlinks to other e-mail
   addresses, none of which are legitimate, with the purpose of committing
   the intended purchaser to become a victim of a criminal offence of
   deception.
   Also worth noting is that the infringer claims through the use of these
   mails that it is protected by copyright and trademark laws under US and
   International Law.â  This is completely incorrect.

   Intellectual and other property rights to the information contained in
   this site are held by TNT Logistics Holdings B.V. and TNT Holding B.V.
                          with all rights reserved.

   In conclusion, the infringer is not only misleading consumers to
   believe it is TNT but, moreover, is stealing the identity, intellectual
   property, and reputation of TNT. Clearly, the infringer has committed
   numerous acts of intellectual property violations, including copyright,
   trademark, and corporate goodwill.
   We herewith formally request that easynet.net shut-down the offending
   domain / mail address and cooperate with TNT and law enforcement
   agencies when it takes the appropriate legal action against the
   infringer.
   I herewith state that, under penalty of perjury, the above information
   in my Notice of Claim of Intellectual Property Infringement is accurate
   and that I am authorised to act on behalf of the intellectual property
   owner.
   DMCA Statement
   As we believe that our copyrighted work has been copied in a way that
   constitutes copyright infringement and is accessible on this site or
   through this service, we notify you as set forth in the Digital
   Millennium Copyright Act of 1998 (DMCA). We have therefore provided
    1. An electronic signature (Daniel J Chapman) authorised to act on
       behalf of the copyright owner.
    2. Identification (TNT Logo and reference) of the copyrighted work
       claimed to have been infringed
    3. Identification of the material that is claimed to be infringing or
       to be the subject of the infringing activity (contained in this
       e-mail correspondence) and that is to be removed or access to which
       is to be disabled as well as information reasonably sufficient to
       permit         yourselves or one of your affiliated companies to
       locate the material
    4. Information reasonably sufficient to permit yourselves to contact
       the complaining party (via the web-site or mail address)
    5. Our statement as a complaining party, that we "in good faith"
       believe that use of the material in the manner complained of is not
       authorised by the ourselves, our agents, or law
    6. Our statement that the information in the notification is accurate,
       and under penalty of perjury, that the author (as the complaining
       party) is authorised to act on behalf of TNT (the owners of the
       exclusive brand, logo and associated trademarks) which have been
       infringed

   ICANN Registrar Accreditation Agreement Clause 3.7.7.2
   3.7.7.2 A Registered Name Holder's willful provision of inaccurate or
   unreliable information, its willful failure promptly to update
   information provided to Registrar, or its failure to respond for over
   fifteen calendar days to inquiries by Registrar concerning the accuracy
   of contact details associated with the Registered Name Holder's
   registration shall constitute a material breach of the Registered Name
   Holder-registrar contract and be a basis for cancellation of the
   Registered Name registration.
