That whole "legal record" argument is a bit of a red-herring.

Courts have consistently held that any form or record (voicemail,
email, sticky-note, database file, etc) are admissible if they are
"normally produced during the regular course of business".  As soon as
any company decides to use a particular form of record during the
normal course of business, the courts accept those records.

If electronic records had no evidentiary value, there would be no
eDiscovery industry, and a lot more crooked executives and investment
bankers roaming the streets right now.
