We have used equipment, and have had no problems getting SmartNet
contracts. A word to the wise - if you are making the decision to go to
another vendor or stay with Cisco, consider this:

All you need is to get a SmartNet contract on a normal piece of Cisco eqpt,
like a 2500 series router, which will not be discriminated against like the
much newer used eqpt. Don't bother adding the disputed used eqpt to the
contract, despite what Cisco says.

When you log on using your contract number, you can get any image of IOS,
and can open a TAC ticket for any piece of Cisco gear with TAC personnel.
Regardless of whether it is used or not. The engineers themselves don't
care, either. Heck, use the online TAC ticet interface to open your own
ticket.

Is it right? Why not, but Cisco would probably disagree. Will it work?
Each and every time.
