I thought anyone ( ham or not ) could do what was necessary to protect life
and property during an emergency.  Seems to me that if you were to hear a
ship sending a distress call and you were the only person around to answer
there would be no problems.
I think something close to this topic came up a year or so ago regarding use
of 2M  rigs in the public service bands. Some hiker used his ham rig to call
for help on a county police net and lost his radio afterwards due to lack of
FCC type acceptance or some such.
