You are absolutely right. As your case rises through the court system, behind the
scenes influences become more important. If you go all the way, the SCoUS does NOT
have to review your case. They can (and usually do) refuse to grant cert without
ever offering any kind of reason.  It's just like the 'flappers' in Gulliver's
Travels.
