Do you have a bug id? I haven't seen this behavior with 7940s/7941, doesn't mean there isn't a problem, jI ust haven't seen this behavior.

Anyone know why cisco phones still ship with a MFG phoneload that
can't DHCP on the voice VLAN correctly? The fix is to configure the
switchport in the voice vlan for data until it gets a firmware update.
 This issue has been around awhile.
