Have you gotten a sniffer capture of this by any chance?
There was an old bug where the phone could receive DHCP responses on  
the data vlan but this only occurred if you had a DHCP server that  
would respond to the voice vlan dhcp request on the data vlan.  Most  
of the time we saw this was when the switch port where the dhcp  
server was connected was in trunk mode.   The dhcp server's nic would  
drop the dot1q header and pass voice vlan data up the stack.

You are correct, the only work around is to register the phone the  
first time on the voice vlan.  After it registers for the first time  
it can be moved to a port that has  switchport access vlan XX  /  
switchport voice vlan XX

Do you have a bug id? I haven't seen this behavior with 7940s/7941,  
doesn't mean there isn't a problem, jI ust haven't seen this behavior.

Anyone know why cisco phones still ship with a MFG phoneload that
can't DHCP on the voice VLAN correctly? The fix is to configure the
switchport in the voice vlan for data until it gets a firmware update.
  This issue has been around awhile.
