Glen,

I have seen the same thing happen, although the original picture is
often credited.  Copyright only works if you clearly state that the
picture is copyrighted.  A notation on the picture works very well if
your software allows it!  Otherwise, while photos are automatically
copyrighted when taken, if the copyright is not stated they can also be
assumed to be in the public domain!
