Hi,

If the article in question is being copied and GIVEN AWAY FOR FREE, then it
falls under the category of "Fair Use", regardless of the objection of the
copyright holder, who will no doubt object simply because they always do.  A
copyright holder will naturally (at the very least) "request" that the
material not be reproduced.  However, it should be understood that it is
nothing more than a "request" and it is not legally binding.  If the material
is being distributed under the "Fair Use" copyright laws, then it is 100%
legal to do so.

below. (Note the translation of this is simply what I stated above in that
passing it on for FREE to other "interested parties" is considered "Fair Use."

If the article you are going to scan is from Electric Radio Magazine, be 
aware that the mag is copyrighted and the editor usually denies 
permission to copy. They also pay for the material so it is their property.

Last year I wrote an article for ERM and became a close acquaintance of 
the editor, Ray N0DMS. However when I asked permission to scan and post 
the article on my web site, he pointed out that the magazine was 
copyrighted. He said that  "I'm going to ask you not post the article" 
and that if I wanted to share with my family, he would send me 
additional copies. (Which he did.)
