If you're running a low CIR (Committed Information Rate) and are exceeding
it there can be congestion-related problems, but I can't see anything
causing CRC errors except for real problems with the circuit somewhere. I
think your ILEC is giving you some bad info and doesn't want to fix what
would appear to be a legitimate problem.
